These Terms of Service ("Terms") govern your access to and use of the website operated by Astro Fresh Jerky, doing business as Astro Jerky ("Astro Fresh Jerky," "we," "us," or "our"), located at astrofreshjerky.com (the "Site"), and your purchase of any products offered through the Site. Please read these Terms carefully before using the Site or placing an order.

1. Acceptance of Terms

By accessing, browsing, or using the Site, or by placing an order through the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Site or purchase any products.

We reserve the right to update or modify these Terms from time to time. When we make material changes, we will revise the "Last Updated" date at the top of these Terms and, where appropriate, provide additional notice (such as a banner on the Site or an email to registered account holders) before the changes take effect. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

To use the Site or make a purchase, you must:

Be at least eighteen (18) years of age, or have the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf;
Be a resident of the United States of America; and
Have the legal capacity to enter into a binding agreement.

We currently ship to all fifty (50) US states only. We do not accept orders for delivery outside the United States.

3. Account Responsibilities

If you create an account on the Site, you agree to:

Provide accurate, current, and complete information during registration and maintain the accuracy of such information;
Maintain the confidentiality and security of your account credentials, including your password;
Accept responsibility for all activities that occur under your account, whether or not authorized by you;
Notify us immediately at info@astrofreshjerky.com if you become aware of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate your account at our sole discretion if we believe your account has been compromised or if you have violated these Terms.

4. Products and Pricing

We strive to provide accurate product descriptions, images, and pricing on the Site. However:

We do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free;
Colors and images displayed on the Site may vary from the actual product due to monitor settings, photography, and other factors;
We reserve the right to correct any errors in pricing or product descriptions and to modify prices at any time without prior notice;
We reserve the right to limit the quantities of any product or service that we offer;
All products sold through the Site are food items. Allergen information is available on product packaging. If you have food allergies or dietary restrictions, please review product packaging carefully before consumption.

5. Orders and Payment

When you place an order through the Site:

Your receipt of an order confirmation does not constitute our acceptance of your order. It is merely an acknowledgment that we have received your order;
We reserve the right to refuse or cancel any order at any time for reasons including, but not limited to, suspected fraud, pricing errors, product unavailability, or other issues identified by our fraud detection systems;
If your order is canceled after payment has been processed, we will issue a full refund to the original payment method;
All payments are processed securely through Shopify Payments. We do not store your complete payment information on our servers;
By submitting an order, you represent and warrant that the payment information you provide is accurate and that you are authorized to use the payment method.

6. Shipping and Delivery

Shipping and delivery of products are governed by our Shipping Policy. All shipping times and estimates provided are approximate and not guaranteed. Risk of loss and title for products purchased through the Site pass to you upon delivery of the products to the carrier.

7. Returns and Refunds

All returns and refunds are governed by our Refund Policy. Please review our Refund Policy for information regarding eligibility, procedures, and timelines for returns and refunds.

8. Rewards Program

We may offer a rewards or loyalty program to our customers. Participation in the rewards program is voluntary and subject to the Rewards Program Terms. We reserve the right to modify, suspend, or terminate the rewards program at any time with reasonable notice to participants. Points, rewards, or benefits earned through the program have no cash value unless otherwise stated in the Rewards Program Terms.

9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, photographs, illustrations, trademarks, trade names, trade dress, page headers, button icons, scripts, software, and code (collectively, "Content"), is the property of Astro Fresh Jerky or its content suppliers and licensors and is protected by United States and international intellectual property laws.

"Astro Jerky," "Astro Fresh Jerky," and all related names, logos, product and service names, designs, and slogans are trademarks of Astro Fresh Jerky. You may not use such marks without our prior written permission.

No right, title, or interest in any Content is transferred to you as a result of your use of the Site. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our express written consent, except as incidental to normal web browsing (such as caching).

10. User Content

If you submit, post, or transmit any reviews, comments, photographs, suggestions, or other materials ("User Content") through the Site, you agree to the following:

You grant Astro Fresh Jerky a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in any media or format, whether now known or hereafter developed;
You represent and warrant that your User Content is original, that you own or have the necessary rights to submit it, and that it does not violate, misappropriate, or infringe the rights of any third party, including intellectual property rights, privacy rights, or publicity rights;
You acknowledge that we are under no obligation to maintain any User Content in confidence, pay compensation for any User Content, or respond to any User Content;
We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion, for any reason or no reason, without notice.

11. Prohibited Uses

You agree not to use the Site in any manner that:

Involves scraping, crawling, or using automated means to access or collect data from the Site without our prior written consent;
Attempts to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;
Interferes with or disrupts the operation of the Site, servers, or networks connected to the Site;
Involves reverse engineering, decompiling, or disassembling any portion of the Site or its underlying software;
Uses the Site or its content for competitive business intelligence or to develop a competing product or service;
Involves harassing, threatening, intimidating, or impersonating any person or entity;
Facilitates or promotes any illegal activity or violates any applicable law or regulation;
Involves uploading or transmitting viruses, malware, or any other harmful code;
Violates these Terms or any applicable law.

We reserve the right to terminate your access to the Site for any violation of these prohibited uses.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS, SERVICES, CONTENT, AND MATERIALS MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASTRO FRESH JERKY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

The Site will be available at all times or will operate without interruption or error;
Defects will be corrected;
The Site or the servers that make it available are free of viruses or other harmful components;
The results of using the Site will meet your expectations.

Nothing on the Site constitutes or is intended to constitute nutritional advice, dietary guidance, or medical advice. You should consult a qualified healthcare provider before making any dietary decisions, particularly if you have food allergies, sensitivities, or medical conditions.

Some jurisdictions, including the State of California, do not allow the exclusion or limitation of certain warranties. In such jurisdictions, the above disclaimers shall apply to the fullest extent permitted by applicable law.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASTRO FRESH JERKY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR ANY PRODUCTS PURCHASED THROUGH THE SITE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ASTRO FRESH JERKY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCTS PURCHASED THROUGH THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO ASTRO FRESH JERKY DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Astro Fresh Jerky, its officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way related to:

Your use of the Site or any products purchased through the Site;
Your violation of these Terms;
Your violation of any applicable law or regulation;
Your User Content;
Your infringement or misappropriation of any third-party rights.

15. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Agreement to Arbitrate

You and Astro Fresh Jerky mutually agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, any products purchased through the Site, or the rewards program (collectively, "Disputes") shall be resolved exclusively through final and binding individual arbitration, rather than in a court of law. This agreement to arbitrate is intended to be broadly interpreted.

Arbitration Rules and Procedures

All Disputes shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. If the AAA is unavailable or unable to administer the arbitration, the parties shall mutually agree upon an alternative arbitration provider. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this arbitration agreement.

Individual Basis Only

All arbitration proceedings shall be conducted on an individual basis only. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, consolidated, or representative proceeding.

CLASS ACTION WAIVER

YOU AND ASTRO FRESH JERKY EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. THIS WAIVER APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW. BY AGREEING TO THESE TERMS, YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court in Los Angeles County, California, for claims that qualify for small claims jurisdiction.

Location

Any arbitration hearing shall be held in Los Angeles County, California, or, at the election of either party, by telephone or videoconference, as mutually agreed upon by the parties.

Fees

If you are the consumer initiating arbitration, Astro Fresh Jerky will pay all AAA filing fees and arbitrator compensation to the extent required by the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys' fees and costs unless the arbitrator determines that applicable law entitles the prevailing party to an award of reasonable attorneys' fees.

Opt-Out Right

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to info@astrofreshjerky.com with the subject line "Arbitration Opt-Out." Your opt-out notice must include your full legal name, the email address associated with your account, and your mailing address. If you opt out of this arbitration agreement, you may pursue any Disputes in a court of competent jurisdiction, subject to the Governing Law and Venue provisions of these Terms. Opting out of arbitration will not affect any other provisions of these Terms.

Severability of Arbitration Provision

If the class action waiver set forth above is found to be unenforceable by a court of competent jurisdiction, then the entirety of this arbitration agreement shall be null and void. If any other portion of this arbitration section is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Survival

This arbitration agreement shall survive the termination of your account, the termination of these Terms, or your cessation of use of the Site.

16. Governing Law

These Terms and any Disputes arising out of or relating to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

17. Venue

For any claims or Disputes not subject to the arbitration agreement set forth in Section 15, you and Astro Fresh Jerky agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Los Angeles County, California, and you waive any objection to venue or jurisdiction in such courts.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Rewards Program Terms, and Accessibility Statement, constitute the entire agreement between you and Astro Fresh Jerky with respect to your use of the Site and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Astro Fresh Jerky regarding the subject matter hereof.

20. Waiver

The failure of Astro Fresh Jerky to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Astro Fresh Jerky.

21. Assignment

Astro Fresh Jerky may assign, transfer, or delegate its rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent.
